PERAN KONSTITUSI DALAM MENJAGA PRINSIP DEMOKRASI DAN SUPREMASI HUKUM DI INDONESIA

Abstract

The implementation of the principle of the supremacy of law in Indonesia is a crucial aspect in maintaining democracy and protecting human rights. This article discusses the legal basis for the supremacy of law in Indonesia, including the provisions in the 1945 Constitution and the role of the Constitutional Court as the guardian of the constitution. Although there has been significant progress since the 1998 reforms, the challenges faced in implementing this principle are still quite significant. Corruption in law enforcement, the dominance of executive power, legal uncertainty, and the lack of legal education in the community are the main challenges that must be overcome. By outlining these challenges, this article also highlights the importance of collaboration between the government, law enforcement agencies, and the community to strengthen the supremacy of law. Consistent law enforcement, transparency in the legislative process, and increasing legal understanding among the community are needed so that the constitution can function as the highest foundation of state law. Through this joint effort, Indonesia can realize its ideals as a just, democratic, and human rights-upholding legal state.
