ANALISIS HUKUM TERHADAP TANGGUNG JAWAB PERUSAHAAN DALAM PROGRAM JAMINAN KESELAMATAN DAN KESEHATAN KERJA (K3) BAGI PEKERJA REMOTE DI INDONESIA

Abstract

This study discusses the implementation of Occupational Safety and Health (OHS) programs for remote workers in Indonesia. This study is motivated by technological developments that drive changes in the world of work, especially the increasing implementation of remote working systems⁠. The COVID-19 pandemic has accelerated the adoption of remote working systems in Indonesia, with data showing a significant increase in workers' readiness to work remotely from 55% in 2020 to 71% in 2023⁠. This study uses a normative legal method with a statutory, conceptual, and comparative approach⁠. The purpose of this study is to analyze the obligations of companies in implementing an OHS program for remote workers and the legal protections available to them⁠. The results of the study show that although OHS is the right of every worker in Indonesia, including remote workers, its implementation still faces various challenges⁠. Companies have an obligation to implement an integrated OHS management system, but often face difficulties in monitoring and assessing risks in an unmonitored work environment⁠. This study also identified a regulatory gap that specifically regulates the implementation of OHS for remote workers, which causes uncertainty in its implementation. In conclusion, further efforts are needed to increase company awareness of the importance of OHS for remote workers, as well as the development of more specific regulations to regulate the protection of worker safety and health in the context of remote work. This study provides an important contribution to understanding the challenges and opportunities in implementing OHS for remote workers in Indonesia, and highlights the need for adjustments to OHS policies and practices in the face of increasingly digital work landscape changes
