Abstract

This research aims to analyze e-commerce provisions in an effort to optimize legal protection of consumers in online transaction activities. The research method used in this research is normative legal research, which is legal research conducted by examining library materials or secondary data. The results of this study indicate that the regulation of e-commerce is not in one whole form of laws or government regulations, but is still interrelated with one law and another, but overall, these regulations are designed to balance the needs of businesses to operate efficiently and the needs of consumers to obtain protection and justice. Comprehensive and regularly updated regulations are essential to deal with the fast-changing dynamics of e-commerce and ensure that the e-commerce ecosystem can thrive while safeguarding the interests of all parties involved. Legal issues concerning consumer protection become even more pressing in the event that a consumer conducts an e-commerce transaction with a merchant in another country. In such long-distance buying and selling, fraud often occurs and thus consumers must be protected. Such fraud can occur with regard to the whereabouts of the seller, with regard to the goods purchased, and with regard to the purchase order and payment by the buyer. The Indonesian government needs to urgently formulate and enact a special law for e-commerce and cyberlaw, which covers consumer protection, dispute resolution, and the responsibilities of parties in online transactions. Every e-commerce agreement should include clauses on limitation of liability, choice of law, and court jurisdiction to prevent disputes and facilitate settlement.
