TINJAUAN YURIDIS TERHADAP TINDAK PIDANA PERDAGANGAN MANUSIA SEBAGAI KEJAHATAN TRANSNASIONAL

Abstract

Human trafficking is a transnational crime that continues to increase, triggering global concern because of its detrimental impact on individuals and society. This phenomenon not only violates human rights, but also threatens the integrity of countries around the world. In the Indonesian context, efforts to overcome this crime are regulated by Law Number 21 of 2007 and receive support from the Palermo Convention and the protocols that regulate it. Despite this, human trafficking continues with a variety of modus operandi, including sending workers with fake documents, time-limited marriages, and adopting babies without proper adoption processes. Law enforcement in Indonesia through preventive and repressive approaches is the basis for tackling human trafficking, but challenges continue to exist with developments in time and technology that affect international mobility. On an international scale, the UN plays an important role in addressing human trafficking through the adoption of global protocols, resolutions and initiatives. With cooperation between countries and a holistic approach, the UN aims to increase the capacity for prevention, law enforcement and victim protection. This journal aims to present a comprehensive understanding of human trafficking as a transnational crime and efforts to overcome it, as well as highlighting the need for international cooperation in facing this challenge.
