ANALISIS YURIDIS TERHADAP PENYEROBOTAN LAHAN NEGARA YANG DIGUNAKAN SEBAGAI KEBUN SAWIT OLEH PIHAK SWASTA DI RIAU

Abstract

Misuseofforestconversion is a formofcorruptionthat notonlyharmsthecountry, but canthreatenthe country's economicstability, and even hinder the country's economic development. Like the company PT Darmex Group owned by Surya Darmadi which has illegally changed the function of forest areas for oil palm plantations covering an areaof 37,095 hectares in Riau from 2003 to 2022, resulting in the state experiencing losses of IDR 39.7 trillion. This research uses normative legal research by analyzing cases in Decision 62/Pid.Sus-Tpk/2022/Pn.Jkt.Pst, so that the approach used is a conceptual, statutory and case approach supported by primary, secondary and tertiary legal materials. The results of this research indicate that decision no. 62/Pid.SusTpk/2022/Pn.Jkt.Pst has violated justice considering that the losses incurredare not small. Eradicating criminalacts of corruptiondoesnot only focuson punishingtheperpetrators, butalsofocuseson returningstate losses according to the amount(assets) thathavebeencorrupted.
