Abstract

The illegal takeover of land by third parties without valid certificates often occurs in various regions of Indonesia. The crucial role of land motivates people to seek and control it. This action has serious and complex legal implications that affect legitimate land ownership rights. Land ownership disputes frequently arise when a piece of land is owned by more than one person with duplicate certificates, and numerous other parties use, build on, and claim land that does not belong to them. The issues addressed in this study are the Factors Causing the Occurrence of Land Takeover Actions by Third Parties without valid certificates (Case Study: Decision 10/G/2023/PTUN.BL) and the Resolution of Problems related to Land Takeover by Third Parties without Valid Certificates, as well as the Protective Measures for Certificate Holders of the Land (Case Study: Decision 10/G/2023/PTUN.BL).
