Abstract

This study examines the impact of the implementation of the Electronic Information and Transactions Law (ITE Law) on freedom of expression on social media, with a focus on the Jerinx criminalization case. Indonesia, as a legal and democratic state, is committed to protecting Human Rights (HAM) and combating fake news. Although the ITE Law was created to shield society from the negative effects of digital content, concerns arise regarding the potential restrictions on freedom of expression. The Jerinx case, illustrating the criminalization through the ITE Law, highlights the imbalance between digital security protection and freedom of expression. Using the Normative Legal method, this research analyzes the judge's considerations in the Jerinx case and explores the impact of the ITE Law on freedom of expression on social media. The results emphasize the need for a revision of controversial articles in the ITE Law, awareness campaigns, and a balance between digital security protection and freedom of expression.
