Abstract

Rights regarding the obligations of workers in obtaining wages to meet the living needs of workers or laborers are of course the responsibility of employers or companies in order to fulfill the rights of these workers. However, sometimes this right is not fulfilled by companies, as is the case with the company PT Aerotrans Services Indonesia which has not paid its employees' wages since 2020, namely during the Covid-19 pandemic. The purpose of this research is to find out if the company does not pay wages in the form of salaries or Holiday Allowances (THR) to workers or laborers, whether they can be subject to sanctions based on statutory regulations and to investigate to provide solutions in the form of legal enforcement or protection. for workers. Of course, legal protection and law enforcement of the rights of workers or laborers in employment relationships is very necessary, plus the position of workers or laborers is sometimes considered still weak in terms of fulfilling their rights, both in terms of wages, policy and social aspects, which as if the government's partiality towards workers or laborers is very minimal. However, if seen from the company's perspective, there are also challenges in fulfilling the obligation to pay wages, such as the challenges of the Covid19 pandemic which affects the economic movement of a company, in this case the government must take part so that the rights and obligations between the company and the workers or laborers can be achieved. Well done. This research certainly reviews primary legal materials, namely researching through statutory regulations such as Laws, Ministerial Decrees, and Government Regulations, and is complemented by secondary legal materials sourced from books and research journals related to this research.
