ASPEK HUKUM PERLINDUNGAN DAN PENEGAKAN HUKUM TERKAIT DESAIN TATA LETAK SIRKUIT TERPADU DI INDONESIA

Abstract

Integrated circuit layout design has a key role in today's technology industry. This allows the merging of thousands of transistors in a single circuit that holds an important role in almost all electronic devices. This research uses normative legal research, with a statutory approach and an analytical approach. Thus, researchers gain a new understanding of the meaning of legal terms and test their implementation through legal analysis. Then the results of the study will be analyzed with descriptive analytical. The results showed that, the legal system of Intellectual Property Rights follows international standards to ensure uniformity of protection across countries. The Law on Integrated Circuit Layout Design grants exclusive rights to rights holders and is valid for ten years after registration. To enforce integrated circuit layout design rights in Indonesia, an in-depth understanding of the legal process is required. The owner of the design may take legal action, both civil and criminal, depending on the nature of the violation and the repercussions that occur. Cooperation with law enforcement officials such as the Police or the Ministry of Law and Human Rights is also important to ensure effective law enforcement. Alternative dispute resolution such as mediation or arbitration can also be options to resolve conflicts more efficiently.
