PERLINDUNGAN PATEN ATAS VARIETAS BARU TANAMAN PADA SEKTOR PERTANIAN DI INDONESIA

Abstract

Patent protection of new varieties of plants is a legal system that gives patent owners exclusive rights to produce, sell, and manage plant varieties that have been recognized as new innovations. The purpose of this system is to encourage farmers to continue to develop high-yielding varieties, so as to increase productivity and quality of agricultural products. The research method used is juridical normative with a statutory approach and a case approach, then analyzed in a descriptive analytical manner. The results of the study show that plant variety protection systems have an important role in encouraging innovation and development of new plant varieties. By granting exclusive rights to breeders, it can increase motivation to carry out qualified plant breeding. In addition, collecting data on local crop varieties is also an important step to maintain biodiversity and encourage the growth of the local agricultural sector. Thus, the system of protection of plant varieties makes a positive contribution to the development of the agricultural sector as a whole.
