PENEGAKAN HUKUM TATA NEGARA DALAM MENJAGA STABILITAS KONSTITUSIONAL DI INDONESIA: ANTARA IDEALITAS DAN REALITAS

Abstract

The enforcement of constitutional law in Indonesia plays a crucial role in maintaining constitutional stability. In Indonesia's legal system, which is based on the supremacy of the constitution, the enforcement of constitutional law aims to ensure that the exercise of state power aligns with constitutional provisions. Principles such as supremacy of the constitution, checks and balances, and due process of law are fundamental to this enforcement. The Constitutional Court and the Supreme Court play strategic roles in reviewing laws and regulations that conflict with the constitution. Additionally, oversight bodies such as the DPR (People's Representative Council) and the Judicial Commission serve to monitor and safeguard legal integrity. However, the enforcement of constitutional law faces various obstacles, such as politicization of state institutions, lack of constitutional understanding among the public, and weak coordination between institutions. Solutions to overcome these obstacles include strengthening the integrity of constitutional bodies, enhancing public constitutional literacy, and improving the legislative system to be more participatory and accountable.
