trademark is an essential element of intellectual property that supports trade and investment by providing a distinguishing identity and a guarantee of the quality of products or services. In the context of company mergers, trademark protection becomes crucial as it often represents a strategic asset that influences business sustainability. This study explores the role of the Directorate General of Intellectual Property (DJKI) in the trademark registration of "GoTo" by PT Aplikasi Karya Anak Bangsa and PT Tokopedia, as well as the legal implications of a trademark dispute with PT Terbit Financial Technology. DJKI plays a key role in ensuring that the trademark registration process adheres to legal principles, including "first to file," territoriality, and distinctiveness, while preventing conflicts with previously registered trademarks. Additionally, DJKI is responsible for resolving trademark disputes fairly and transparently to maintain legal certainty and the rights of trademark owners. This process involves in-depth technical and legal analysis, such as in the GoTo case, where part of the trademark registration was rejected due to a conflict with an earlier registered trademark. This research highlights the importance of strengthening regulations and dispute resolution mechanisms that are more transparent, educating business actors, and fostering cross-institutional collaboration among academia, practice, government, and non-governmental organizations. Therefore, DJKI’s role is highly strategic in supporting an effective, fair, and competitive intellectual property protection system.
