Abstract

In Fisheries activities, fishermen are given Traditional Fishing Rights in accordance with UNCLOS 1982. The Fishermen's Rights are then given by the local government in accordance with their respective regions, one of the regions is fishermen in Batam City. The problem that occurs is that the governance of the capture fishermen area in Batam is not well implemented. In this study, this research aims to examine and socialize the enforcement of traditional fishermen's rights in Batam, as well as an effort from the academic side to prevent international marine conflicts. This research uses normative legal research method. Based on the results of the research, it can be concluded that first, the regulations managed by the Government from the highest to the lowest regulations are well written, but have not been implemented effectively and have caused several problems. Second, many problems arise, such as reclamation not in accordance with the guidelines in the Law listed. Third, the Batam City Government's efforts as regulator and facilitator have not been well implemented according to the results of interviews conducted by the author to fishermen.
