Abstract

Discrimination is an action directed at individuals based on their membership in a particular group. Indonesia has regulations governing Acts of Discrimination. This research aims to find out how a form of action can be categorized as an act of discrimination according to Indonesian law and how efforts to protect rights related to discrimination using normative legal research methods are concluded: 1. Forms of actions that can be categorized as acts of discrimination in Indonesian law are in Law No. 40 of 2008 in more detail in Article 4, then based on the analysis of the Denny Sumargo case does not meet the elements of discrimination against the BugisMakassar tribe than Article 16 of Law No. 40 of 2008. 2. In Indonesia, legal efforts to protect rights related to discrimination have been regulated in Law No. 40 of 2008 on the Elimination of Racial and Ethnic Discrimination. Those who have the authority to provide protection for rights related to discrimination are the government, local governments, and the community, and involve the participation of all citizens carried out in accordance with the provisions of laws and regulations.
