Abstract

Persecution is arbitrary treatment by torturing and oppressing others which causes pain and/or injuries. Persecution is a criminal offence. Persecution is regulated in articles 351 – 356 of the Criminal Code (KUHP). According to the science of education, Islamic boarding schools are religious institutions that provide education and teaching as well as develop and spread Islam, where students live together in dormitories. Pondok Pesantren as a place of study should be a safe and comfortable place for students. According to Article 45 of the KUHP, an immature child is one who is not yet 16 years old. Minors are given special protection before the court. If a minor commits a crime, the sentence will be reduced.
