PEMENUHAN HAK-HAK PEKERJA AKIBAT PEMUTUSAN HUBUNGAN KERJA PADA MASA PANDEMI COVID-19

Abstract

Termination of employment often triggers industrial relations conflicts between workers and employers. The country of Indonesia is currently experiencing a very high economic crisis caused by the emergence of the spread of the Corona Virus. Which is where many companies do layoffs. Labor is an important factor in a company. Companies have an obligation to comply and fulfill employee rights. Dhapu Ava Koffiee Restaurant and RT Coffee Shop which have cooperation agreements with employees who do not fulfill workers' rights as stipulated in Employment Constitution number 13 of 2003 concerning Manpower Article 156 states that "In the event of termination of employment, the companies are obliged to pay severance and/or long service pay and compensation”. However, in practice there are still many companies that forget one of these workers' rights. The purpose of this thesis is: first, to find out the obstacles in fulfilling workers' rights due to termination of employment during the Covid-19 pandemic at Dhapu Ava Koffiee and RT Coffee Shop. Second, to find out the settlement in fulfilling workers' rights due to termination of employment during the Covid-19 pandemic at the Dhapu Ava Koffiee restaurant and RT Coffee Shop.This type of research is empirical or sociological juridical research. This research was conducted at the Dhapu Ava Koffiee Restaurant and RT Coffee Shop, the population and sample were all parties related to the problems studied in this study. Sources of data used are primary data, secondary data and tertiary data with the collection technique in this study is qualitative. The results of the study show that the fulfillment of workers' rights due to termination of employment at the Dhapu Ava Koffiee Restaurant and RT Coffee Shop based on applicable regulations has not been fulfilled because of this, obstacles arise in fulfilling the rights of laid-off workers are have no wage agreement given by the Dhapu Ava Koffie restaurant and RT Coffee Shop to employees who are laid off, in solving problems the fulfillment of workers' rights must be in accordance with the agreement in the agreement. The author's suggestion is for the Dhapu Ava Koffiee restaurant and RT Coffee Shop to ensure that the rights of workers/laborers are granted properly by the company and the resolution of problems is carried out in accordance with the agreement so that the rights of workers/laborers are still fulfilled without pressing only workers' obligations.
