Abstract

This study discusses the contractual aspects of the existence of a cooperation agreement on forest land management by Perhutani which resulted in a change in the function and designation of the forest. The problem under study is the existence of a cooperation agreement between Perhutani and a third party as a corporation where Perhutani's land as state land is transferred to natural tourism objects with a production sharing clause in the agreement. The formulation of the problem given by the author is whether Perhutani may convert forest land into natural tourism objects and whether the rules allow production sharing agreements between Perhutani and third parties as corporations. The research method used is normative juridical using statutory and conceptual approaches. The results of this study are that Perhutani is allowed to convert forest land into a tourist object on condition that it obtains approval from the Minister and continues to maintain the sustainability and protection of forests and there are no rules that allow profit-sharing with third parties because it conflicts with the state's right to control land.
