PEMBATASAN KEWENANGAN NOTARIS DALAM MELAKUKAN PRAKTIK PENGURUSAN IZIN USAHA BERBASIS ONLINE SINGLE SUBMISSION

Abstract

Licensing is one of the important aspects in business life for orderly administration as a condition for establishing a business entity. A notary as one of the officials authorized ton establish a business entity through an authentic deed has limitations, namely as long as this authority is regulated in the Law on Notary Position. It is often found that notaries carry out the practice of the opbtaining business licenses, especially on the basis of Online Single Submission, which are implicitly not regulated clearly Notary regulations. The formulation of the problem proposed by the author is the limit of Notary authority in obtaining business licenses based on Online Single Submission and sanction for Notaries who practice obtaining business permits based on Online Single Submission. The writing used by the author uses normative legal research using a statute approach. Result of the discussion is that in the regulations regarding risk-based business licensing, it is expressly not found that the authority of a Notary in the case of obtaining business licenses by a Notary is only based on the power of attorney and sanction given to Notaries who violate the practice of obtaining business licenses based on Online Single Submission have not been strictly regulated in both the code of ethics and Notary office regulations.
