URGENSI PENERAPAN SURAT KETERANGAN PENDAFTARAN TANAH (SKPT) DALAM PROSES PERMOHONAN LELANG ATAS TANAH

Abstract

The transfer of rights over land which is immovable property by its nature must be carried out with the transfer of names to provide legal protection. This includes the transfer of rights through an auction, in the end land registration will be carried out. The existence of requirements for fulfilling the SKPT for land auction applications creates obstacles where the Land Office does not provide a period for the issuance of the SKPT related to the application from the Auction Office. The formulation of the research problem is the urgency of applying the SKPT related to the auction application and the effectiveness of the application of the SKPT in the framework of carrying out the auction. This study uses a type of normative juridical research using statutory approaches and conceptual approaches. The results of this study are that the position of the SKPT is very important in the context of carrying out the auction where the SKPT contains information regarding whether there are encumbrances, transfers, blocks and disputes over the land parcels that will be auctioned and the application of the SKPT as a condition for the auction has not been effective because the Land Office does not provide a time period issuance of SKPT.
