Abstract

The current Civil Law in Indonesia is the result of the codification of the Dutch Civil Code, namely Burgerlijk Wetboek (BW) which has been in effect until now. Civil Law in Indonesia recognizes the term Unlawful Acts (PMH) or in Dutch called onrechtmatige daad which is regulated in Article 1365 of the Civil Code, namely “Every unlawful act that causes harm to another person, obliges the person who through his fault caused the loss, to compensate for the loss”. The purpose of writing this journal is to analyze the elements of Unlawful Acts (PMH) and how legal considerations in the Case Study of PT Petro Indah Indonesia vs. PT Duta Tambang Gunung Perkasa. The case, which began on May 14, 2019, occurred when PT Petro Indah Indonesia demanded compensation for losses suffered due to the non-disclosure of legal issues related to the mining concession land by the Defendants.
