IDENTIFIKASI PENYALAHGUNAAN IZIN TINGGAL YANG DILAKUKAN WARGA NEGARA ASING (WNA) BERDASARKAN UNDANG-UNDANG NOMOR 6 TAHUN 2011

Abstract

Abuse of immigration residence permits often occurs, highlighting the need for stricter enforcement of immigration law in line with active laws. The increasing number of cases of immigration violations, especially by foreign nationals (WNA) in Indonesia, shows that there is increasingly widespread misuse of residence permits. In this research, normative juridical research methods were used. Abuse of residence permits often occurs, such as IZ, a foreigner from Russia who was sentenced to Immigration Administrative Action (TAK), namely deportation for carrying out activities as a tennis coach, which violated the terms of the residence permit granted. Law enforcement regarding violations of residence permits by foreigners in Indonesia follows a series of stages, starting from monitoring foreigners through checking administrative data and field supervision, taking action against foreigners who violate residence permits, and monitoring the administrative completeness of foreigners who wish to enter Indonesian territory. The government's efforts to prevent misuse of residence permits include monitoring the presence of foreigners in Indonesia, increasing public awareness about the importance of monitoring the presence of foreigners in Indonesia, as well as increasing criminal law enforcement for misuse of residence permits by providing strict criminal sanctions for foreigners who violate applicable regulations. In this research, it was found that law enforcement regarding violations of residence permits from foreigners in Indonesia is very important to maintain state sovereignty and avoid misuse of residence permits which can have an impact on security and public order. For this reason, more effective efforts are needed to prevent misuse of residence permits and increase public awareness about the importance of monitoring the presence of foreigners in Indonesia.
