PERLINDUNGAN HUKUM UNTUK SEORANG TERSANGKA TERHADAP KEKERASAN YANG DILAKUKAN OLEH KEPOLISIAN

Abstract

The existence and survival of human beings cannot be separated from interactions between one individual and another individual which are based on the human passion for interacting with other humans for the sake of fulfilling life. Interactions that occur between individuals also do not escape the existence of legal relationships between individuals which indirectly give rise to rights and obligations and their consequences. The existence of an individual, in this case, a citizen, has the right to obtain recognition, guarantees, protection and fair legal certainty as well as equal treatment before the law as stated in Article 28D paragraph (1) of the 1945 Constitution of the Republic of Indonesia so that it can be seen that the state guarantees the rights of citizens as individuals to obtain recognition, guarantees, protection and legal certainty as well as equality before the law, even though the status attached to the person is a suspect, in fact there are still widespread acts of violence in the investigation of a suspect. This research uses a normative juridical method with a statutory approach, a conceptual approach and a historical approach with secondary legal material.
