Abstract

This research aims to explain the accountability of police officers for their negligence which killed residents in Pandeglang, Banten according to Indonesian positive law. By taking a general overview and some related data first regarding the accountability of police officers for their negligence which resulted in the death of a citizen in an area, namely Pandeglang. This general overview includes a general overview of the view of the police code of ethics based on the Police Law, as well as criminal liability for police officers for negligence in the form of wrongful shooting cases. This research will analyze in more depth the theories related to the accountability of police officers for their negligence that killed someone and provide a deeper understanding of the police code of ethics and the criminal responsibility of police officers. The conclusion of this research is that the implementation of the use of firearms must be in accordance with the implementation mechanism for on-site shooting as well as procedures regarding the use of firearms by members of the Indonesian National Police. Where the use of firearms must be in accordance with the provisions of the Regulation of the Head of the National Police of the Republic of Indonesia Number 8 of 2009 concerning the Implementation of Human Rights Principles and Standards in Carrying out the Duties of the National Police of the Republic of Indonesia. Based on these regulations, regulations regulate the use of firearms in shooting on site. So, the police officer can be held accountable for all his actions related to the use of firearms before the law and to his superiors.
