ANALISIS YURIDIS TANGGUNG JAWAB PIHAK YANG MELAKUKAN WANPRESTASI DALAM KONTRAK WARALABA (Studi Putusan Nomor 1064 K/Pdt/2020)

Abstract

The franchise agreement is a contract that defines the obligations of the franchisor and the franchisee. The franchisee must comply with the current agreement if he accepts the franchise that has been awarded to him. The research method used is normative legal research. With a statutory approach, namely examining current laws and regulations, other relevant literature, and case studies related to the topic of legal responsibility for defaults on franchise agreements by the parties. The conclusion of this study is, in the event that one of the parties to the franchise agreement defaults, the legal liability of the franchise agreement is regulated in Government Regulation of the Republic of Indonesia Number 42 of 2007 Article 16 paragraph (1) juncto Regulation of the Minister of Trade of the Republic of Indonesia Number 53/MDAG/PER/8 /2012 Articles 32 and 33.
