Abstract

Maladministration in public services remains a recurring issue in Indonesia's administrative law practice. This study aims to analyze whether maladministration is caused by systemic failure or bureaucratic misconduct, and to examine the relationship between the two within the framework of Administrative Law. This research employs a normative juridical method with statutory and conceptual approaches. The findings reveal that maladministration cannot be viewed dichotomously as either systemic failure or individual misconduct, but rather as the result of their interaction. A complex and inefficient administrative system creates broad discretionary space, while weak integrity and oversight mechanisms increase the likelihood of abuse of power. Therefore, maladministration reflects a holistic failure of governance. This study recommends strengthening public service system design, limiting discretion, and optimizing oversight mechanisms to prevent maladministration.
