PROBLEMATIKA HUKUM PENETAPAN LAHAN SAWAH DILINDUNGI (LSD) DI INDONESIA

Abstract

The legal problems of protected paddy fields (LSD) are related to land use, plantation expansion, and ecosystem reform. One of them is because inadequate government regulations and weak oversight have made business people and developers not pay attention to the principles of sustainable development, and prioritize economic benefits. This of course raises a very complex legal problem and requires the right solution. The purpose of this study is to explain the legal problems of protected paddy fields (LSD) in Indonesia. The research method uses normative-empirical, with a qualitative approach that uses methods through library research. The results of the research are that the government in accordance with Law no. 41 of 2009 concerning Protection of Sustainable Food Agricultural Land, along with Government Regulation (PP) No. 1 of 2011 concerning the Determination and Transfer of Functions of Sustainable Agricultural Land and Presidential Regulation Number 59 of 2019 concerning controlling the conversion of paddy fields.
