Abstract

The growth of the property sector utilizing the pre-project selling scheme has given rise to various legal concerns, particularly delays in unit delivery by developers that result in consumer losses. This investigation purposes to examine the legal liability of developers and the forms of consumer protection, using the Meikarta project as a case study. The study adopts a normative juridical approach through statutory analysis and case examination.  The findings demonstrate that delays in unit delivery constitute a breach of contract caused by licensing constraints, incomplete construction readiness, and unequal bargaining power between the parties. In such situations, developers are required to perform their obligations, compensate for losses, or terminate the agreement in accordance with legal provisions. Accordingly, stronger regulatory oversight and law enforcement are essential to ensure legal certainty and safeguard consumer interests.
