This study discusses how judges determine breach of contract in credit agreements contained in authentic deeds, referring to Decision Number 22 PK/Pdt/2026. The research uses a normative legal method with a case approach. The results show that the breach occurred because the debtor failed to fulfill payment obligations after the agreed time had passed, while the authentic deed served as strong supporting evidence. The court considered the dispute as a contractual matter and rejected the claim based on unlawful conduct. The reasoning in the decision mainly focuses on the performance of the agreement and does not extensively address other aspects, including the possibility of bad faith. Therefore, a broader approach is needed so that the assessment of breach of contract does not only ensure legal certainty, but also reflects fairness.
