Abstract

Disputes over the distribution of inheritance are common in civil law practice, particularly when the deceased leaves no direct descendants, which often leads to disagreements among the heirs. Such a dispute is reflected in the Supreme Court Decision Number 4296 K/Pdt/2025 in conjunction with Decision Number 162/PDT/2025/PT SMG and Decision Number 194/Pdt.G/2024/PN Skt concerning the distribution of inheritance among siblings. This study aims to analyze the distribution of inheritance among siblings and to examine the conformity of the application of inheritance law in these judicial decisions. This research employs a normative legal research method using statutory and case approaches. The results indicate that the heirs, totaling nine individuals, possess equal legal standing, thereby entitling each of them to an equal share of the deceased’s estate. Furthermore, the Supreme Court at the cassation level essentially upheld the decisions of the lower courts, demonstrating consistency in the application of inheritance law in resolving the dispute over the distribution of inheritance.
