Abstract

The development of mobile phone networks in modern times is very fast with the support of very advanced technology. Mobile phone is a means of communication that multifunction can be carried easily by the owner / user. In general, it must be guaranteed with a warranty from the manufacturer and distributor (factory warranty). Many businesses do everything possible to double profits and minimize production costs as little as possible, even by violating the provisions of the law. Black market or known as black market is a business of buying and selling goods obtained illegally from various countries outside Indonesia. To improve discipline in carrying out the task of supervision and service to the act of smuggling, there needs to be stricter regulations in the implementation of transactions. Black market practices violate 3 things that concern business activities, including intellectual property rights, business ethics and transaction laws. The crime of smuggling is caused by various factors including geography, production market and society. With the principle of legal certainty in the provisions of the UUPK has an impact on consumers so that they have difficulty obtaining their rights. Consumers have to make legal efforts that require long processes and procedures and cost a lot of money. Hope the government can be more assertive in cracking down on black market actors in Indonesia. Supervision of government employees, especially customs employees themselves, must be tightened because government employees are the catalyst for black market activities in Indonesia. If there is no legal protection and legal certainty for consumers, then e-commerce in Indonesia has no quality.
