Abstract

This study aims to analyze the forms of unlawful acts (PMH), the legal responsibility of Land Deed Officials (PPAT), and the legal implications of Supreme Court Decision Number 1370 K/Pdt.Sus-PHI/2022 on land deed practices in Indonesia. This decision has been highlighted because it reaffirms the principle of public officials' responsibility for the legal products they issue, particularly in the context of land deeds that have authentic evidentiary force. This study uses a normative juridical method with a case approach and a statute approach, by examining primary legal sources in the form of court decisions, as well as secondary sources such as literature, government regulations, and land law doctrine. The results show that PPATs have full legal responsibility to ensure the formal and material validity of each deed they make. Negligence in the data verification process, the presence of the parties, and the validity of basic documents can be considered an unlawful act that causes harm to other parties. In its ruling, the Supreme Court affirmed that a formally flawed deed not only loses its evidentiary force but can also be legally annulled. The implications of this ruling strengthen the role of Land Deed Officials (PPAT) as legal officials obligated to uphold the principles of prudence, professionalism, and moral integrity in their duties. Furthermore, this ruling serves as important jurisprudence for the supervision and training of PPATs, leading to more orderly, accountable, and equitable land practices in Indonesia.
