JUDICIAL REVIEW SEBAGAI INSTRUMEN PENGUJIAN KONSTITUSIONALITAS UNDANG-UNDANG DALAM SISTEM HUKUM INDONESIA

Abstract

Judicial Review is a mechanism to examine the constitutionality of a law in force within Indonesia’s law system. This mechanism allows the constitutional court reviews law and review whether the existing laws in conflict with 1945 Constitution of the Republic Indonesia. Hence, Judicial review aims to uphold constitutional supremacy, protect the rights of Indonesian citizens, and ensure the laws or legislative policies remain consistent with the principles of democracy and rules of law. This study aims to examines the position of judicial review within the Indonesian legal system and analyze the constitutional court’s authority in conducting constitutional review to protect the citizens constitutional rights. Using normative research method, utilizing a statutories approach and to analyze juridical review as a mechanism for examining and supervising law or legislative policies.
