Abstract

A sale and purchase agreement is an important form of economic transaction that is regulated by the Indonesian Civil Code (KUHPerdata), which aims to protect the interests of all parties involved. The law governing sale and purchase agreements aims to protect the rights and obligations of both parties, namely buyers and sellers, and ensure legal certainty in economic transactions. This research uses a qualitative method with a literature study approach to discuss the legal aspects related to default that occurs when one party fails to fulfill its obligations according to the agreement. Default can be a total or partial violation, which can be addressed through legal steps such as demands for fulfillment of the agreement, cancellation, or compensation. This research shows that clear regulations in the Civil Code provide a guarantee of legal certainty in sale and purchase agreements, which is important for creating fair and transparent transactions, and reducing potential disputes in the economic world.
